PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS. Any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or any products or services purchased through Rogue Tailor will be resolved exclusively through binding arbitration, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. By agreeing to these Terms, you and Rogue Tailor each waive the right to a trial by jury and the right to litigate disputes in state or federal court. Arbitration will be conducted on an individual basis only — you and Rogue Tailor agree not to bring or participate in any class, collective, consolidated, or representative action or arbitration, and the arbitrator has no authority to consolidate claims of more than one party. Arbitration will be administered by the American Arbitration Association under its consumer arbitration rules, and the arbitrator's decision will be final and binding on both parties. If any part of this arbitration agreement is found unenforceable, the remainder will still apply, except that the class action waiver may not be severed from the requirement to arbitrate on an individual basis.
